Go check your mainboard's site for driver updates, or ATI's site(though if it's on board video it'll probably be at the mainboard site). Also might try re-installing DirectX 8. There's also a patch on the gtinteractive site. Worth a shot. If not post again and I'll do some more searching.

The game works fine for me, though I had to downgrade my detonator drivers to fix graphics problems. Did you mean DX8 isn't supporting AGP or the game isn't?
